Die Autorit\u00e4tskrise des Staates f\u00fchrt zu erh\u00f6htem Druck auf die Justiz.<\/strong><\/p>\n\n\n\n

Die hierarchische Struktur erleichtert es einer autorit\u00e4ren Regierung die gew\u00fcnschte politische Linie auch in der Justiz durchzusetzen.<\/strong><\/p>\n\n\n\n

Solange es nur um Kriminalit\u00e4t ging, fiel das nicht auf. Der Landesminister konnte sich br\u00fcsten, Kinderpornographie zu verfolgen und den Medien Futter zu liefern und die Fiktion der Unabh\u00e4ngigkeit der Justiz aufrecht erhalten.  Jetzt aber verlangt die Regierung Solidarit\u00e4t mit dem Regierungskurs und Folgsamkeit.<\/p>\n\n\n\n

Die Verwaltungsgerichte sind reihenweise gefolgt: Regierungskritische Demonstrationen von Querdenkern werden verboten, andere werden erlaubt. Wenigstens wollen sie noch den Anschein der Rechtsstaatlichkeit bewahren und schieben Hygieneregeln vor. Wenn es aber um widerspenstige Richter geht, ist Alarm angesagt und der Richter bekommt wie in Weimar die H\u00e4rte des Staates zu sp\u00fcren.<\/p>\n\n\n\n

Auch die Nazis hatten nicht sofort die gesamte Justiz im Griff und brauchten daf\u00fcr eine Zeit. Jetzt wird auch die Strafjustiz dem politischen Regime unterworfen: Dass auch \u00c4rzte allein aufgrund von Ger\u00fcchten und der \u00fcblen Nachrede von politischen Kontrahenten vor Gericht gezerrt werden, zeigt, dass auch die Strafjustiz in den politischen Sog geraten ist und bedeutet eine neue Qualit\u00e4t in der politischen Auseinandersetzung.<\/p>\n\n\n\n

Politische Justiz gab es bisher nur in den Cum- Ex-Verfahren, als Finanzbeamte, welche die Finanzbetr\u00fcger verfolgen wollten, zum Psychiater geschickt wurden. Erst als sich f\u00fcr die SPD- Opposition eine Chance ergab, daraus Kapital zu schlagen, deckte Borjans die Betr\u00fcgereien auf. Ungl\u00fccklicherweise stellte es sich heraus, dass Scholz  neben Sch\u00e4uble der Hauptt\u00e4ter bei den Zuwendungen an die Finanzindustrie in Milliardenh\u00f6he war.<\/p>\n\n\n\n

Nachdem immer mehr offenbar wird, wie durch und durch korrupt das Parteiensystem, das in Berlin herrscht, agiert, ist eine allgemeine Legitimationskrise  entstanden. Kein Schulleiter kann den Corona- Betrug zugeben, er muss sich dem Narrativ beugen, alle Beh\u00f6rdenleiter m\u00fcssen bei Strafe der Versetzung den Maskenzwang durchsetzen und die Impfkampagne bef\u00f6rdern. Alle Betriebsleiter m\u00fcssen sich unterordnen oder Nachteile sp\u00fcren. Dabei sind die Millionenzahlungen an Abgeordnete f\u00fcr Maskendeals nur die kleineren Skandale. Diese werden von den Medien schnell herunter geb\u00fcgelt und verschwinden in der Versenkung.<\/p>\n\n\n\n

Obwohl man nach dem Krieg eigentlich eine unabh\u00e4ngige Justiz installieren wollte, k\u00f6nnen sich bis heute die Staatsanwaltschaften nicht dem politischen Druck entziehen. Der Generalstaatsanwalt kann Anklagen aufgrund politischer Opportunit\u00e4t zulassen oder ablehnen. Er ist weisungsgebunden und unterliegt der politischen F\u00fchrung. In der Barschel- Aff\u00e4re wurde der Generalstaatsanwalt, weil er der politischen F\u00fchrung nicht genehm war, schnell ausgetauscht und durch einen willigen ersetzt. Letztlich entscheidet in NRW also Laschets Kabinett dar\u00fcber, welcher politische Prozess gerade opportun ist.<\/p>\n\n\n\n

So wirkt die Nazivergangenheit bis in unsere Zeit hinein. Geschichte wiederholt sich eben doch.<\/p>\n\n\n\n

Judiciary under political pressure<\/strong><\/p>\n\n\n\n

The state’s crisis of authority leads to increased pressure on the judiciary.<\/p>\n\n\n\n

The hierarchical structure makes it easier for an authoritarian government to impose its desired political line on the judiciary as well.<\/p>\n\n\n\n

As long as it was only about crime, this was not noticed. The state minister could boast about prosecuting child pornography and providing fodder for the media, and maintain the fiction of the judiciary’s independence. Now, however, the government demands solidarity with the government’s course and docility.<\/p>\n\n\n\n

The administrative courts have followed suit in rows: Demonstrations critical of the government by dissenters are banned, while others are allowed. At least they still want to preserve the appearance of the rule of law, and they are pushing hygiene rules. But when it comes to recalcitrant judges, the alarm is sounded and the judge gets to feel the harshness of the state, as in Weimar.<\/p>\n\n\n\n

Even the Nazis did not immediately have the entire judiciary under control and needed time to do so. Now criminal justice is also subjected to the political regime: The fact that even doctors are being hauled before the courts solely on the basis of rumors and the slander of political opponents shows that criminal justice has also fallen into the political maelstrom and signifies a new quality in political debate.<\/p>\n\n\n\n

Until now, political justice only existed in the Cum Ex proceedings, when tax officials who wanted to prosecute the financial fraudsters were sent to the psychiatrist. Only when the SPD opposition had a chance to capitalize on this did Borjans expose the fraud. Unfortunately, it turned out that Scholz, along with Sch\u00e4uble, was the main culprit in the billions of dollars in contributions to the financial industry.<\/p>\n\n\n\n

Now that it is becoming more and more apparent how thoroughly corrupt the party system that rules in Berlin is, a general crisis of legitimacy has arisen. No head of school can admit to the Corona fraud, he must bow to the narrative, all heads of authorities must enforce the mask compulsion under penalty of transfer and promote the vaccination campaign. All agency heads must submit or feel disadvantage. Yet the million-dollar payments to deputies for mask deals are only the minor scandals. These are quickly ironed out by the media and disappear into oblivion.<\/p>\n\n\n\n

Although an independent judiciary was supposed to be installed after the war, the public prosecutor’s offices still cannot escape political pressure. The attorney general can approve or reject indictments based on political expediency. He is bound by instructions and subject to the political leadership. In the Barschel affair, the attorney general was quickly replaced because he did not suit the political leadership and was replaced by a willing attorney general. Ultimately, Laschet’s cabinet in NRW decides which political process is opportune at any given moment.<\/p>\n\n\n\n

In this way, the Nazi past continues to have an effect into our own time. History repeats itself after all.<\/p>\n\n\n\n
